Terms of Service

Last updated: August 2026

By accessing or using Zen in the Noise, you agree to be bound by these Terms of Service.

1. Who We Are

Zen in the Noise ("we", "us") is operated by [Legal Entity Name], registered in [Country] under registration number [Number], with its registered office at [Address]. VAT ID: [VAT ID].

Contact: master@zeninthenoise.com

Payments and subscription billing are handled by Creem (creem.io), our Merchant of Record. For billing matters, Creem acts as the seller of record.

2. The Service

Zen in the Noise provides evidence-based earnings intelligence: algorithmic structural analysis (Anchor/POC, AVWAP, dryness, tightness), explainable verdicts, and narrative briefings, which may be drafted with the assistance of a language model. The Service is an observational and educational tool.

3. IMPORTANT โ€” NOT FINANCIAL ADVICE

We are not a broker-dealer, investment adviser, or financial planner, and we are not registered with any securities regulator. Nothing in the Service is investment advice, a recommendation, or a solicitation to buy or sell any security or derivative.

Content is general information only. It does not take into account your objectives, financial situation, or needs. Narrative briefings are summaries generated from historical data with the assistance of a language model; they are informational only and are not personalized recommendations.

Risk warning: trading stocks and derivatives involves substantial risk of loss. You may lose your entire investment. The Service is not suitable for every investor.

Historical patterns and statistical win-rates do not guarantee future results. Testimonials reflect individual experience, not typical results.

You are solely responsible for your trading decisions. Where required, consult a licensed financial adviser.

4. Eligibility

You must be at least 18 years old and legally able to enter contracts. The Service is void where prohibited.

5. Trial, Subscription & Billing

Free trial: 7 days. No payment card is required. When the trial ends, access pauses and nothing is charged.

Price: $400 per year. VAT or other taxes are added where applicable; the total price is shown at checkout before you pay.

Auto-renewal: after your first paid year, the subscription renews annually at the then-current price unless you cancel before the renewal date. By subscribing, you agree to auto-renewal as described in these Terms. Creem, our Merchant of Record, emails you a renewal notice between 7 and 30 days before each renewal, stating the amount, the billing date, and a link to manage or cancel your subscription.

Cancellation: cancel at any time via your Creem customer portal or by contacting us. You retain access until the end of the paid period. No partial refunds are provided for unused time.

6. Your Statutory Rights (EEA & UK)

If you reside in the EEA or UK, you have a 14-day right of withdrawal under consumer law. If you request immediate access to the digital service and confirm the waiver box at checkout, you lose this right once delivery begins. Our voluntary guarantees below are additional and do not limit your statutory rights.

7. Refunds

We offer a 7-day money-back guarantee on your first paid subscription period. Contact us within 7 days of your first charge for a full refund. Subsequent renewals are non-refundable, except where the law requires otherwise.

8. Acceptable Use

You agree not to: (a) share account credentials; (b) scrape, resell, or automate extraction of the Service's data or verdicts; (c) use the Service for any unlawful purpose.

9. Intellectual Property

All content, models, and verdicts are our property. You receive a limited, personal, non-transferable license to use the Service.

10. Privacy

How we handle your data is described in our Privacy Policy.

11. Disclaimers & Limitation of Liability

The Service is provided "as is" and "as available". We do not warrant the accuracy, completeness, or timeliness of data or analysis. Market data comes from third-party sources and may be delayed or incorrect. Algorithmic analysis and AI-assisted briefings may contain errors; verdicts are historical observations, not predictions.

To the maximum extent permitted by law, we are not liable for trading losses, lost profits, or indirect damages arising from use of the Service.

Nothing in these Terms excludes liability that cannot be excluded under applicable law (including the Australia Consumer Law, UK consumer law, and EU consumer law). Where a statutory guarantee applies and cannot be excluded, our liability is limited to resupply of the Service or the cost of resupplying it.

12. Term & Termination

We may suspend or terminate accounts that breach these Terms. You may cancel at any time as described in Section 5.

13. Changes to These Terms

We may update these Terms. Material changes will be announced by email or dashboard notice at least 7 days before they take effect. Continued use after the effective date constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of [Country/State], without prejudice to mandatory consumer protections of your country of residence.

15. General

If any clause is unenforceable, the rest remains in force. These Terms and the Privacy Policy form the entire agreement between you and us.
